Place 1 City Councilman Rick Bennett was indicted in June for abuse of official capacity.
The misdemeanor charge stemmed from Bennett's actions last year resulting in the forced retirement of then-Mineral Wells Police Chief Mike McAllester.
Last December, an inquiry panel consisting of Mayor Mke Allen and Ward 2 Council member Tammy Underwood found Bennett violated Section 28 of the city charter through a series of events culminating with his meeting with City Manager Lance Howerton and a group of Mineral Wells police officers prior to Howerton's decision to remove McAllester from his position.
In September, visiting State District Judge Monte Lawlis quashed the indictment after ruling the city charter and city's code of ordinances are spearate and that violations of a city charter are not punishable under the state's criminal statutes.
